TERMS OF SALE

Effective Date: February 1, 2026

These Terms of Sale govern all purchases made through the Delgado Photo Co. online print store hosted by Pixieset (“Store,” “we,” “us,” “our”). By placing an order, you agree to these Terms.

1. Platform & Fulfillment

Our print store is hosted by Pixieset. All photographic products are fulfilled and shipped by a professional third-party printing laboratory (“Lab”).

Delgado Photo Co. does not manufacture, print, or ship physical products directly.

2. Orders & Payment

All orders must be paid in full at the time of purchase.

Prices are listed in U.S. dollars and may be subject to applicable taxes and shipping fees.

We reserve the right to refuse or cancel any order due to errors, availability issues, or suspected fraud.

3. Custom & Made-to-Order Products

All photographic prints and products are custom-made to order.

Because of their personalized nature, all sales are final, except as outlined in Section 6.

4. Production & Delivery

Production

Production times vary by product and Lab availability. Estimated timelines are provided at checkout but are not guaranteed.

Shipping

Shipping timelines are estimates only. Delgado Photo Co. is not responsible for delays caused by carriers, customs, weather, or other factors beyond our control.

Risk of Loss

Once an order is transferred to the shipping carrier, risk of loss passes to the purchaser.

5. Color, Crop & Quality Disclaimer

We make every effort to ensure accurate representation of our artwork. However:

Screen displays vary by device and calibration.

Printed products may differ slightly in color, tone, contrast, or crop.

Minor variations are inherent to professional printing processes and are not considered defects.

By purchasing, you acknowledge and accept these natural variations.

6. Returns, Replacements & Defective Products

Due to the custom nature of photographic products:

All sales are final. Returns and refunds are not offered.

Damaged or Defective Items

If your product arrives damaged, defective, or materially flawed, you must notify us within 5 days of delivery and provide clear photographs of:

The damage or defect

The original packaging

We will submit a replacement request to the third-party Lab on your behalf.

If approved by the Lab, a replacement will be issued at no additional cost.

Replacement decisions are subject to the Lab’s policies and quality standards.

Delgado Photo Co. is not responsible for issuing refunds for Lab-related production issues.

7. Copyright & Usage Rights

All photographs remain the exclusive intellectual property and copyrighted work of Delgado Photo Co.

Purchase of a print grants you a personal, non-commercial license only.

You may not reproduce, scan, copy, distribute, resell, or use the images for commercial purposes without written consent.

8. Pricing & Order Errors

We reserve the right to correct pricing, typographical, or system errors at any time.

If an order is affected by an error, we may cancel and issue a full refund.

9. Limitation of Liability

To the fullest extent permitted by law, Delgado Photo Co. shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase, use, or inability to use our products.

Our total liability shall not exceed the amount paid for the purchased product.

10. Force Majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, labor disputes, supply shortages, transportation interruptions, or system outages.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted on this page and apply to future purchases.
